Upload Terms

By uploading music, photos, video or other content ("Content") to Animoto, whether you’re a Registered User or a Contributor using an invitation link, you agree to these Upload Terms, Animoto’s Terms of Service, and Animoto’s Privacy Policy,

You represent and warrant that:

  1. You have the right to upload the Content and use the Content in Animoto videos;
  2. You have obtained all necessary third-party permissions;
  3. The Content does not infringe any third-party rights (including copyrights, privacy rights, or publicity rights);
  4. The Content does not contain viruses or malicious code;
  5. The Content does not violate any laws, rules, or regulations, including those related to defamation, harassment, privacy, intellectual property, obscenity, or child protection; and
  6. The Content complies with Animoto’s Terms of Service.

You consent to Animoto's collection, use, and processing of your personal information (including your name, email address, and uploaded Content) as described in Animoto's Privacy Policy.

You grant Animoto a royalty-free perpetual right and license to host, reproduce, distribute, display, modify, and otherwise use the Content as needed to provide Animoto services and enable you to create videos.

In addition to the indemnification in Animoto’s Terms of Service, you agree to defend, indemnify and hold Animoto (including its parent companies, subsidiaries, agents, affiliates, employees and officers) harmless from and against all claims, actions, demands, expenses, losses or liabilities (including attorney's fees), arising from the Content or any breach of these representations and warranties.

If You are a Contributor: If you are uploading Content via an invitation link from a Registered User, you are not required to create an Animoto account. By uploading Content, you agree to these Upload Terms and the relevant portions of Animoto's Privacy Policy. Your uploaded Content will be incorporated into the Registered User’s account and videos. You may request deletion of your personal information by contacting Animoto at privacy@animoto.com.

If You are a Registered User: If you invite Contributors to upload Content, you are fully liable for all Content they upload. You agree to defend, indemnify and hold Animoto harmless from any claims arising from Contributor content. This liability is in addition to any liability of the Contributor.
